Trump Can And Should Be Disqualified From The Presidency, Per The Constitution.

The 14th Amendment of the Constitution section 3 states:

Disqualification from Holding Office. No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

This amendment, written back in 1866 clearly states what Donald Trump did to this Country and those elected officials inside of the Capital. Violates the Constitution of the United States. As it also lays out what the punishment will be. For his actions around the 2020 Presidential election and his participation leading up to and since January 6th, 2021.

The whole country watched live on every television network. Trump sent his MAGA army to the U.S. Capital in Washington D.C.. Just blocks from where he was holding his event to “Stop the Steal”. Trump along with his usual cast of characters. That included nut job attorneys, Republican congresspeople, his offspring, and other right-wing figures. All who gave, pump-up speeches filled with lies and instructions. Pleading with the frenzied crowd, that without them stopping the constitutional counting of the electoral votes. They would lose their country.

So Clearly Trump sent his MAGA Army to the Capital. After he summoned those supporters to Washington D.C in the first place.

Trump who promised to walk the crowd to the Capital. Begrudgingly went back to the White House to watch his plan unfold on TV.

At the White House, he secluded himself and relished in the horrific scenes that played out at the United States Congressional building. While a terrified Nation waited for his immediate response.

As many government officials were scrambling to get resources to the Capital that day. The Commander and Chief of the most powerful military in the world. Refused to react or instruct anyone to get support for the overwhelmed Capital Police Force. Neglecting his constitutional duties he swore an oath to. It wasn’t till hours later and at the pleading of his staff. That he would even reference peace. In what was an improvised love letter to those who had carried out his plan.

Trump shows his gratitude to those he sent to overthrow the Congress.

Even once the insurrection was over and Trump had time to reflect. Instead of condemning the violence he created. He victim blames those who were terrorized by his mob’s attack. In a Twitter tirade, void of truth, that sheltered the attackers from any fault. While expressing his gratitude for his MAGA troops. He then boasts about the historic relevance of what they’ve done together.

This was his summary of the events at the Capital on January 6th, 2021.

Trump, who is once again lying his way to a Republican nomination for the Presidency. Has vowed to protect those who carried out his violent coup attempt. By giving the convicted insurrectionists presidential pardons. If Trump is once again elected to Office.

The overwhelming evidence has been studied by Constitutional experts William Baude of the University of Chicago, and Michael Stokes Paulson of the University of St. Thomas. They concluded, “The bottom line is that Donald Trump both ‘engaged in’ ‘insurrection or rebellion’ and gave ‘aid or comfort’ to others engaging in such conduct, within the original meaning of those terms as employed in Section 3 of the 14th Amendment,”

Stating that not only Trump should face consequences for the events around January 6th. “There is a list of candidates and officials who must face judgment under Section 3” — a roster that could include Republicans in Congress and in state governments. “Former president Donald Trump is at the top of that list.”.

The two scholars are Republicans. They are members of the Federalist Society. Which is defined as “an American conservative and libertarian legal organization that advocates for a textualist and originalist interpretation of the U.S. Constitution “.

Negating false narratives that will arise from Right Wing politicians. That this would be a plan created by Liberals. To keep Trump from eligibility for the office of the President.

So what would it take to get the ball rolling on Trump’s disqualification? The two experts say “anyone whose job it is to figure out whether someone is legally qualified” to hold office and to be included on state ballots — that is, state election administrators, typically the secretaries of state.”

Secretaries of State in any state could remove Trump from their state’s Presidential ballots. Most likely in one of the many Democratic lead State governments. This move would then be challenged in court by conservative groups. Eventually making it’s way to The Supreme Court.

The top court in the land may be weighted in favor of Conservatives. However, the overwhelming evidence would be hard for the court to ignore.

Republicans across the nation have spent the last few years whitewashing the events of January 6th. Downplaying the trauma it caused to our democracy. It’s time for elected Democrats to fight back. The legal path has been paved by Constitutional experts. Now the States need to protect their citizens before the election. Removal of Trump from ballots is their only legal recourse. Actions, that will be called into question by MAGA talking heads everywhere. When it’s what the 14 Amendment section 3 of the Constitution clearly demands.
