(CNN )— “The Supreme Court on Friday rejected a request by special counsel Jack Smith to fast-track arguments on whether Donald Trump has any immunity from federal prosecution for alleged crimes he committed while in office.
The court did not explain its reasoning and there were no noted dissents.
The court’s decision is a major blow to Smith, who made an extraordinary gamble when he asked the justices to take the rare step of skipping a federal appeals court and quickly deciding a fundamental issue in his election subversion criminal case against Trump.
Both sides will still have the option of appealing an eventual ruling by the DC Circuit Court of Appeals up to the high court, but the court’s move is a major victory for Trump, whose strategy of delay in the criminal case included mounting a protracted fight over the immunity question, which must be settled before his case goes to trial.
An expedited review of the issue is already underway at the DC Circuit, which has scheduled oral arguments for January 9. The election subversion trial is currently set to begin in March.
In urging the court to not take the case, Trump’s attorneys argued the special counsel was trying to “rush to decide the issues with reckless abandon.””
Well, that sucks!! For now anyway. Special Counsel Jack Smith took a big ole swing and a miss at settling the question of Presidential immunity that will at some point be decided by the Supreme Court. From what I’m hearing Jack Smith’s request was so unusual that he didn’t make a strong enough argument for the Supreme Court to decide to take him up on it. It was incumbent upon Smith to make an exceptional argument for the Supreme Court to rule in his favor. Apparently, that wasn’t the case in his lackluster appeal to the highest court in the land.
The good news is that this is already on the fast track in the D. C. Circuit Court of Appeals so after that, the Supreme Court will have to take the case once that decision is made. You can’t knock the hustle of Jack Smith for trying this long shot. But with the calendar soon approaching 2024, pressure is definitely mounting to get this thing going. Because God forbid Trump were to be elected, his collection of criminal indictments would be thrown out faster than a used condom.
Stay tuned to this breaking story as I’m sure it will wipe yesterday’s bombshell that Trump was recorded on audio trying to strong-arm election officials in Michigan to not certify the election results off the front pages. I guess we just can’t have good news for too long in this country before something like this 💩 takes precedence.
