(CNN) —“A federal appeals panel expressed deep skepticism Tuesday toward Donald Trump’s argument that he can’t be prosecuted for trying to overturn the 2020 election, raising the potentially extreme implications of absolute presidential immunity.
Trump’s lawyers argued that his federal election subversion indictment should be dismissed because he is immune from prosecution. But the three judges on the US Court of Appeals for the District of Columbia Circuit panel questioned whether this immunity theory championed by Trump’s lawyers would allow presidents to sell pardons or even assassinate political opponents.
Special counsel Jack Smith’s team argued that a president is not above the law, warning that allowing presidential immunity from prosecution would open a “floodgate” and saying that it would be “awfully scary” if there were no criminal mechanism to stop future president’s from usurping the vote and remaining in power”
Well, that did not go well for Trump and his lawyers. If the three Judge panel would’ve pantsed Trump’s lawyer and laughed at the size of his manhood. He could’ve at least left the courtroom with the possibility of winning the decision on the basis of pity. But instead he chose to bring a ridiculous argument that has no chance of being on the right side of the Judges’ ruling. I guess that’s what happens when your argument is basically that Presidents can do whatever they want no matter how illegal their conduct is.
Suggesting that the only repercussion for a Criminal and Chief would be impeachment. Well if that were the case, no one told Republican Senators, because their lone reason for acquittal during Trump’s second impeachment. Was, that the Justice System would enforce the legal ramifications of the January 6th insurrection.
Trump’s lawyer also argued that due to his acquittal in his second impeachment trial, he could not face further prosecution because that would fall under double jeopardy. Again such an ignorant legal theory. You see impeachments are a political process and hold zero legal consequences for a President who is convicted. Plus the bar is much higher for criminal prosecution than that of impeachment.
Just take for example what the Republicans are doing with President Biden. They have no evidence of wrongdoing or criminal activity, yet they are still proceeding with an impeachment inquiry. Even with no proof to support allegations, if Republicans had 60 Senators they could convict Biden in an impeachment trial. When it comes to the Justice System unless there is sufficient evidence you can’t even charge someone never mind convit because you disagree with their policies.
If Trump’s argument that Presidents have unlimited immunity were to win, what then would stop President Biden from canceling the election and declaring himself the winner? According to Trump’s legal team that would be fine. Democrats do have the majority in the Senate so that would block Republicans from convicting him if they tried to stop him via impeachment. So there would be nothing stopping a President from refusing to leave office. Sounds like a dictatorship to me.
The mere fact that Trump feels that should be the law of the land exposes how much he views democracy as a hurdle that he believes should be removed. If given a second chance at the Presidency, Trump now has enough knowledge to overcome those obstacles that stood in his way at the end of his first term. As Judge Tanya Chutkan said of Trump, “Presidents are not Kings” and Trump “is not President”. Now let’s make sure that we keep it that way!! Or King Trump will be our sad reality, in just a little more than a year from now.
