(CNN) — “Former President Donald Trump has lost the first of several attempts to throw out a lawsuit that seeks to block him from the 2024 presidential ballot in Colorado, based on the 14th Amendment’s prohibition against insurrectionists holding public office.
Colorado District Judge Sarah Wallace this week rejected Trump’s bid to get the lawsuit dismissed on free-speech grounds.
In a 22-page ruling, Wallace said she wasn’t swayed by Trump’s argument that the lawsuit seeks to improperly restrict his rights to participate in the political process.
“The Court has no difficulty concluding that it is to the benefit of the general public that, regardless of political affiliation, only constitutionally qualified candidates are placed on the ballot,” Wallace wrote.
She added that resolving the question of Trump’s eligibility is particularly important because he is seeking “the highest office in the country” and “the disqualification sought is based on allegations of insurrection against the very government over which the candidate seeks to preside.””
Great News out of Colorado today as a judge threw out Donald Trump’s attempt to have a lawsuit dismissed. The suit, if it were to win would ban Trump from appearing on Colorado’s Presidential Ballots. Due to his involvement in the January 6th insurrection on Congress.
The 14th Amendment section 3 states: “Disqualification from Holding Office.No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”
The lawsuit is one of many against Trump challenging his eligibility for office that are being filed in multiple states across the country. The text of the 14th Amendment is quite clear in banning anyone who previously swore an oath to the Constitution. Then “engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”
It’s as if those who wrote that section of the amendment back in 1866 were given an iPad with the footage from January 6th by time travelers. Because they absolutely nailed it! What is discouraging is that there aren’t similar lawsuits currently in all 50 states.
Even if Trump were to be convicted on all 91 charges he is facing, in his handful of cases, he would still be eligible for the presidency. This means the few lawsuits citing the 14th Amendment are the only Constitutional recourse that Trump faces.
Republican Secretaries of State have said they will not remove Trump from the ballot because the voters should decide. But that argument doesn’t hold water. For example, I bet a lot of people would also vote for Arnold Schwarzenegger if he was on the ballot but he too is disqualified from being President because he’s not a naturalized citizen.
It’s truly astounding that this cause hasn’t been supported by more people throughout the nation. This is the only legal remedy that Democrats have to keep Trump out of office. Yet even Democratic Secretaries of State in a majority of places haven’t supported efforts in their states. For elected officials who swore an oath to protect and defend the Constitution. To just ignore that the Republican Party’s potential Presidential nominee is banned from even running for office is a dereliction of their duties.
It’s as if everyone is just waiting for someone else to fix this Trump dilemma. The Congress said it was up to the courts so they refused to convict during his impeachment trial. Now the courts have his criminal trials but as noted they cannot sentence him to “not run for President”. Now Secretaries of State across the land are tossing Trump the human hot potato onto citizens who must sue to protect the country. From “A person holding office, that previously swore an oath to support the Constitution, who engaged in insurrection or given aid or comfort to the enemies thereof.” It’s scary to think that no elected officials in this country have acted on the behalf of “We The People” ignoring what their counterparts back in 1866 were warning against. If they are waiting on time travelers from a future America to warn them of their inaction on Trump. There may be no United States in the future because those running the country now are leaving Trump’s eligibility up to fate. 🫣

Trump is the one backing Russia and Putin over Ukraine not the Democrats. We the People voted Biden and the Democrats into office. It’s Republicans who have to lie, cheat and steal to maintain power.
